Terms and Conditions

1. Introduction

1.1 These Terms and Conditions apply to the provision of services by Pest Shield North East Ltd (trading as Pest Shield Pest Control) to the person or business purchasing the services (“you”).

1.2 By accepting our quotation, booking services, or allowing works to commence, you are deemed to have accepted these Terms.

2. Our Services

2.1 We will deliver our services with reasonable care and skill in line with current industry standards.

2.2 Any timeframes provided are estimates only and are not guaranteed.

2.3 Pest control is not an exact science. We do not guarantee complete eradication, particularly where factors outside our control exist (including neighbouring properties, environmental conditions, or hygiene standards).

3. Your Responsibilities

3.1 You must:

• Provide safe and reasonable access to the property at agreed times
• Follow all advice and recommendations provided
• Ensure the environment is suitable for treatment (including hygiene and access)

3.2 Failure to comply may:

• Reduce treatment effectiveness
• Result in additional visits and charges

3.3 We are not responsible for:

• Re-infestation
• Activity originating from neighbouring properties
• Issues caused by structural defects not addressed

4. Access and Missed Appointments

4.1 If we attend and are unable to gain access, or access is refused:

• A missed appointment fee of £50 + VAT will be charged

4.2 If access is repeatedly unavailable, we reserve the right to:

• Cancel the remaining service
• Charge for scheduled visits

5. Fees and Payment

5.1 All pricing is provided in our quotation or invoice.

5.2 Residential:

• Payment is due on the day of service

5.3 Commercial:

• Payment terms are NET30

5.4 We reserve the right to:

• Charge interest at 8% above Bank of England base rate
• Add statutory compensation under the Late Payment of Commercial Debts legislation
• Apply a £40 + VAT administration fee for debt recovery

5.5 All payments must be made in full without deduction.

6. Cancellations

6.1 A minimum of 24 hours’ notice is required to cancel or rearrange an appointment.

6.2 Failure to provide notice may result in a £50 + VAT charge.

7. Materials and Equipment

7.1 Any materials left on site (including bait stations, traps, or monitoring equipment) remain the property of Pest Shield North East Ltd unless otherwise agreed.

7.2 We reserve the right to:

• Remove equipment at any time
• Charge for lost, damaged, or tampered equipment

8. Proofing and Installation Works

8.1 All proofing and installation work is guaranteed for 12 months unless stated otherwise.

8.2 This guarantee does not cover:

• Damage caused by rodents or wildlife after installation
• Failures due to structural movement or third-party works

8.3 Maintenance requirements:

• Bird netting and proofing should be inspected every 6 months
• Drain protection devices should be periodically checked

Failure to maintain may void any guarantee.

9. Ongoing Contracts

9.1 Contract services are provided on an ongoing basis as agreed.

9.2 Unless otherwise stated:

• Contracts are subject to a minimum term of 12 months

9.3 Either party may terminate with 30 days written notice after the minimum term.

9.4 We reserve the right to adjust pricing with reasonable notice.

10. Liability

10.1 Our total liability is limited to the total fees paid for the services.

10.2 We are not liable for:

• Loss of profit
• Business interruption
• Indirect or consequential losses

10.3 We are not liable for:

• Ongoing pest activity outside our control
• Failure of treatments where recommendations are not followed

10.4 Nothing limits liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation

11. Termination

11.1 We may suspend or terminate services immediately if:

• Payment is overdue
• You breach these Terms
• Access is not provided

12. Force Majeure

12.1 We are not liable for delays caused by events beyond our control including weather, supply issues, or access restrictions.

13. Communications

13.1 All notices must be provided in writing via email or post.

14. General

14.1 Failure to enforce any part of these Terms does not waive our rights.

14.2 If any part is unenforceable, the remainder remains valid.

15. Governing Law

15.1 These Terms are governed by the laws of England and Wales.
